DOE INSTRUCTIONS
Under Section 50131 of the IRA, up to $330 million is provided for adopting and implementing: (A) a building energy code (or codes) for residential buildings that meets or exceeds the 2021 International Energy Conservation Code (IECC), or achieves equivalent or greater energy savings; (B) a building energy code (or codes) for commercial buildings that meets or exceeds the ANSI/ASHRAE/IES Standard 90.1–2019, or achieves equivalent or greater energy savings; or (C) any combination of building energy codes described in subparagraph (A) or (B). This funding will support States and units of local government that have authority to adopt building codes in adopting, implementing, enforcing, and measuring compliance rates of certain building energy codes that meet or exceed the minimum energy savings specified in the IRA, while training and educating their workforce and building localized capacity. Recipients must develop an implementation plan that provides approaches to achieve full compliance with the adopted code, plans for capacity building to support ongoing implementation, and active workforce training and enforcement programs.

Adoption and Implementation of Innovative Building Energy Code Approaches by States and Certain Units of Local Government
Only applicants who have submitted an eligible Concept Paper will be eligible to submit a Full Application.
Two-page concept paper criteria include:
- Proposed project, code for adoption, and how it will achieve targeted FOA outcomes
- Risks, challenges, and mitigation strategies, and project community impacts
- Demonstrate need for the proposed project
- Demonstrate eligibility
- How the proposed project would meet objectives, if successful
Each Concept Paper must be limited to a single project and should not exceed two pages in length. DOE published an optional template for applicants’ convenience on the infrastructure exchange.
DOE will encourage or discourage full application based on concept paper review.

Jurisdiction Scenario 1:
Your jurisdiction has no authority to adopt an energy efficiency standard since this is the responsibility of the state.
Your jurisdiction is seeking funding for streamlined adoption of IECC Appendix CC or the Zero Code.
Jurisdiction Scenario 2:
Your jurisdiction has authority to adopt an energy efficiency standard and renewable energy standard.
Your jurisdiction is seeking funding for: Streamlined adoption of IECC 2021 and Appendix CC (or possibly ASHRAE Standard 90.1-2022 instead of IECC 2021).
Jurisdiction Scenario 3:
Your jurisdiction is seeking local adoption of a Renewable Energy Standard (RES) which would apply to both new and existing buildings (Similar to San Francisco).
New buildings would be designed to meet existing local or state energy efficiency standards.
